§ 1 General Information

Your personal data (e.g. title, name, address, email address, telephone number) will only be processed by us in accordance with the provisions of German data protection law and the data protection law of the European Union (EU).

The following provisions inform you about the purposes of processing, the legal bases, recipients, and storage periods, as well as about your rights and the controller responsible for the processing of your data.

This Privacy Policy applies only to our websites. If you are redirected to other websites via links on our pages, please refer to the respective websites for information on how your data is handled there.

§ 2 Contacting Us

(1) Purpose of Processing

We process the personal data you provide to us by email, contact form, or other means in order to respond to and handle your enquiries.

You are not obliged to provide us with your personal data. However, without providing your email address, we will not be able to respond to you by email.

(2) Legal Bases

a) If you have given us your explicit consent to process your data, the legal basis for this processing is Article 6(1)(a) GDPR.

b) If we process your data for the performance of pre-contractual measures, the legal basis is Article 6(1)(b) GDPR.

c) In all other cases (in particular when using a contact form), the legal basis is Article 6(1)(f) GDPR.

RIGHT TO OBJECT: You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data based on Article 6(1)(f) GDPR and not carried out for direct marketing purposes.

In the case of direct marketing, you may object to the processing at any time and without giving reasons.

(3) Legitimate Interest

Our legitimate interest in processing your data is to communicate with you quickly and to respond to your enquiries in a cost-effective manner.

If you provide us with your postal address, we reserve the right to use it for direct marketing by post.

You may protect your privacy by limiting the amount of personal data you provide, e.g. by using a pseudonym.

Hosting providers; postal and delivery service providers for direct marketing.

(5) Storage Period

Your data will be deleted as soon as the circumstances indicate that your enquiry or the matter concerned has been conclusively resolved.

If a contract is concluded, however, we will retain the data required under commercial and tax law for the statutory retention periods, which are generally ten years (see Section 257 of the German Commercial Code (HGB) and Section 147 of the German Fiscal Code (AO)).

1. Right of Access

Pursuant to Article 15 GDPR, you may request information about the personal data concerning you that we process.

2. Right to Rectification

If the information concerning you is inaccurate or no longer accurate, you may request rectification pursuant to Article 16 GDPR.

If your data is incomplete, you may request that it be completed.

3. Right to Erasure

You may request the erasure of your personal data under the conditions set out in Article 17 GDPR.

4. Right to Restriction of Processing

You have the right, within the scope of the requirements of Article 18 GDPR, to request the restriction of the processing of your personal data.

5. Right to Data Portability

Pursuant to Article 20 GDPR, you have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format, or to request that such data be transmitted to another Controller.

6. Right to Withdraw Consent under Data Protection Law

Pursuant to Article 7(3) GDPR, you have the right to withdraw your consent to the processing of your personal data at any time.

The lawfulness of processing carried out on the basis of your consent prior to its withdrawal shall remain unaffected.

7. Right to Lodge a Complaint with a Supervisory Authority

If you believe that the processing of your personal data violates the GDPR, you have the right, pursuant to Article 77 GDPR, to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or the place of the alleged infringement.

Please also note your right to object pursuant to Article 21 GDPR:

a) General: Objection on grounds relating to your particular situation

Where your personal data is processed

• to safeguard our overriding legitimate interests (legal basis pursuant to Article 6(1)(f) GDPR), or

• in the public interest (legal basis pursuant to Article 6(1)(e) GDPR),

you have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data; this also applies to profiling based on these provisions of the GDPR.

In the event of an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

b) Special case: Direct marketing – objection without giving reasons

Where your personal data is processed for the purpose of direct marketing, you have the right to object at any time and without giving reasons to the processing of your personal data for such purposes; this also applies to profiling insofar as it is related to such direct marketing.

If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes.
